Acceptance of these terms
These Terms of Service govern your access to and use of Zigglor, including the Zigglor website, Growth Platform, AI-assisted solution generator, solution catalogue, hosting and publishing services, subscriptions, engineering workflows, communications and related services.
By creating an account, accessing a paid service, submitting an order, clicking an acceptance control, or using the platform, you agree to these Terms and the Privacy Policy. If you do not agree, do not use the services.
Business use: If you use Zigglor for a company or other organization, you represent that you have authority to accept these Terms on its behalf.
02 · Eligibility
Who may use Zigglor
You must be legally capable of entering into a binding agreement and must comply with the laws applicable to you. If you are under the applicable age of majority, you may use the services only where permitted by law and with the involvement or consent of a parent, guardian or authorized adult where required.
03 · Accounts
Account responsibilities
- Provide information that is accurate, current and not misleading.
- Keep your password and authentication methods confidential.
- Do not share access in a way that circumvents plan, security or usage limits.
- Promptly notify Zigglor of unauthorized access or suspected compromise.
- You are responsible for activity performed through your account unless caused by Zigglor's failure to apply reasonable security measures.
04 · Services
What Zigglor provides
Zigglor provides technology and growth services that may include websites and applications, AI-assisted solution generation, implementation, hosting, analytics, automation, integrations, reporting, recommendations, engineering workflows and related support.
Features may change over time as Zigglor improves the platform. We may add, modify, suspend or discontinue features where reasonably necessary for security, technical, commercial or legal reasons. Paid services will be handled according to the applicable order, plan or subscription terms.
05 · AI-generated output
AI solutions and generated content
Zigglor may use AI to generate software, content, designs, business recommendations, diagnoses, analytics summaries and other outputs. AI output is generated from the information and instructions available to the system and may contain errors, omissions or assumptions.
You must review and validate generated output before using it in production. You are responsible for confirming that content, claims, business logic, integrations, third-party licenses and regulatory requirements are appropriate for your use case.
Unless a written agreement says otherwise, purchasing an AI-generated solution does not transfer ownership of Zigglor's platform code, reusable frameworks, internal tooling, prompts, models, proprietary methods or other underlying technology.
06 · Orders and implementation
Requests, quotes and implementation
A request, proposal, solution preview or quote is not necessarily an acceptance of an order. An implementation becomes binding when the applicable commercial terms are accepted and any required payment is successfully received or another written agreement confirms commencement.
Scope, integrations, content, hosting, domain registration, third-party services, revisions, support and delivery timelines may vary by project. Where a quote or order identifies specific inclusions, those terms control for that transaction.
07 · Pricing and taxes
Prices, discounts and charges
Prices shown on Zigglor may be stated in USD while payments processed through Paystack may be charged or settled in KES using the applicable exchange-rate logic displayed or communicated at checkout. The final amount presented for payment is the amount authorized for that transaction.
Coupons and promotional discounts are subject to their stated conditions, validity periods, usage limits and eligibility rules. A discount may be withdrawn or rejected where the coupon is invalid, expired, already used, incompatible with the order, or obtained through abuse.
Taxes, regulatory charges, domain-registration charges, third-party fees or other pass-through costs may apply where stated at checkout or in the applicable order.
08 · Payments
Payment processing
Payments are processed through the payment methods made available by Zigglor and its payment providers. Zigglor may verify payment status with the payment provider before marking an order as paid or publishing a solution.
You authorize Zigglor and the applicable payment provider to process the amount associated with your selected order or subscription. Do not submit payment credentials through channels that Zigglor has not designated for payment.
09 · Subscriptions
Recurring services
Where you select a recurring plan, you authorize recurring charges according to the billing cycle, price and subscription terms displayed at the time of purchase. Recurring services may include ongoing growth work, hosting, monitoring, analytics, support or other plan-specific services.
You may request cancellation through the platform where available or by contacting support@zigglor.com. Cancellation does not automatically reverse amounts already properly charged or obligations already incurred, unless required by applicable law or the applicable commercial terms.
10 · Hosting and domains
Published websites and hosting
Zigglor may provide subdirectory hosting or standalone hosting depending on the option selected at checkout. Standalone hosting may involve domain registration, DNS, SSL, email or other third-party services. Availability, renewal, registration and transfer of a domain can depend on the applicable registrar and registry.
Subdirectory websites may be published under a Zigglor-controlled path. You are responsible for the legality and accuracy of the content, products, services and claims presented on your published website.
Zigglor may suspend or restrict a website where necessary to address non-payment, security incidents, abuse, unlawful content, infringement, material breach or technical risk, subject to applicable law and any contractual notice requirements.
11 · User content
Your content and permissions
You retain rights you already own in the content, data, trademarks, images, documents and other materials you submit. You grant Zigglor the limited rights necessary to host, process, reproduce, modify, transmit and display that content to provide the services you request.
You represent that you have the rights and permissions required to submit the content and instruct Zigglor to process it. Do not upload content that infringes another person's rights, contains unlawful material, or exposes confidential information without authorization.
12 · Acceptable use
Prohibited activities
You must not use Zigglor to violate law or third-party rights, distribute malware, interfere with platform security, attempt unauthorized access, abuse payment systems, impersonate another person or organization, send unlawful or deceptive communications, infringe intellectual property, or use the platform to operate services that Zigglor reasonably determines create unacceptable legal, security or operational risk.
You must not use generated systems or hosted websites to facilitate unlawful activity. Zigglor may investigate suspected abuse and take proportionate protective action.
13 · Intellectual property
Zigglor technology and branding
The Zigglor name, branding, platform design, software, source code, reusable components, workflows, templates, documentation and other Zigglor materials are owned by or licensed to Zigglor and are protected by applicable intellectual-property laws.
Except for rights expressly granted to you, these Terms do not transfer ownership of Zigglor technology. You may not copy, resell, reverse engineer, extract proprietary components, or create a competing service from Zigglor's protected platform materials except where applicable law expressly permits it.
14 · Third-party services
Integrations and external providers
Zigglor may integrate with third-party services including payment processors, authentication providers, hosting providers, domain registrars, email systems, AI services, analytics systems and other APIs. Third-party availability and performance are outside Zigglor's direct control.
Your use of a third-party service may be subject to that provider's separate terms and privacy policy. You authorize Zigglor to make the API calls and data transfers reasonably necessary to deliver an integration you have requested.
15 · Availability
Service availability and maintenance
Zigglor aims to provide reliable services but does not guarantee uninterrupted or error-free operation. Planned maintenance, infrastructure failures, third-party outages, security incidents, internet conditions and other events may temporarily affect availability.
Where reasonably practical, Zigglor will work to restore affected services and communicate material incidents affecting paid services.
16 · Disclaimers
Important limitations
Except where a written agreement expressly provides otherwise or applicable law prohibits exclusion, Zigglor provides the platform and AI-assisted outputs on an “as available” and “as is” basis. We do not guarantee that every recommendation will produce a particular business result, that generated software will satisfy every possible requirement without review, or that third-party services will remain available.
Growth scores, ROI calculations, diagnoses, forecasts and recommendations are decision-support tools. They are not guarantees of revenue, profit, conversion, traffic or other commercial outcomes.
17 · Liability
Responsibility and liability
To the maximum extent permitted by applicable law, Zigglor will not be responsible for indirect, incidental, special, consequential or loss-of-profit damages arising from your use of the platform. Nothing in these Terms excludes liability that cannot lawfully be excluded or limited.
Where liability limitations are enforceable, the maximum aggregate liability of Zigglor in connection with a particular paid service will generally be limited to the amount paid for that service during the applicable period, except where a different limitation is required by law or expressly agreed in writing.
18 · Indemnity
Your responsibility for misuse
To the extent permitted by law, you agree to defend and hold Zigglor harmless from third-party claims, losses or reasonable costs arising from your unlawful use of the services, infringement caused by content you supplied, unauthorized access caused by your failure to protect credentials, or material breach of these Terms.
19 · Suspension and termination
Account and service termination
You may stop using the platform at any time. Zigglor may suspend or terminate access where reasonably necessary because of a material breach, fraud, abuse, non-payment, security risk, unlawful activity, or a legal requirement.
On termination, provisions that by their nature should survive will continue, including payment obligations, intellectual-property provisions, disclaimers, limitations of liability, dispute provisions and rights relating to previously processed transactions.
20 · Governing law
Disputes and applicable law
These Terms are intended to be governed by the laws of Kenya, unless mandatory law applicable to you requires otherwise. The parties should first attempt in good faith to resolve a dispute through direct communication with Zigglor.
Nothing in these Terms removes any consumer, privacy or other mandatory statutory right that cannot lawfully be waived.
21 · Changes to these terms
Updates
We may update these Terms as the platform, services, pricing or legal requirements change. The updated version will be published on this page with a revised effective date. Continued use of the services after an update takes effect constitutes acceptance to the extent permitted by law.
